Revolutionizing Delivery: Amazon drones take flight amid changing UAS regulations

Amazon Prime Air recently gave a presentation on its drone delivery operations to locals in College Station, Texas, and Lockeford, Calif., where deliveries began in December 2022. Amazon advertises that drone delivery is available for “thousands” of items, a small fraction of its vast online retail listings. Items shipped using drone delivery services go in special packaging designed to offer protection for the product during the delivery process. Amazon Prime Air has developed the mk27-2 air vehicle, which can carry a 5-pound payload up to 12 kilometers at a speed of 50 mph. The six-rotor unmanned aircraft system (UAS) is capable of taking off vertically, then rotating to level flight. The company highlights the drone’s level of autonomy, features that are claimed to enhance safety. The drone is designed to drop packages from a height of 12 feet and can detect if a heat signature is below to avoid dropping the packages on people. The drone’s level of autonomy helps it be “independently safe,” a spokesperson for the company said, which allows the drone’s algorithms to help it make smarter decisions when it comes to safety. Amazon has previously experienced drone setbacks and concerns over safety, with more than eight incidents in 2022 involving delivery drones during tests. One incident resulted in a 20-acre fire when a motor failed during testing operations. Amazon has stated the company is in full compliance with the Federal Aviation Administration (FAA) and has not had an enforcement action against its operations during the program has been operating. Future Regulatory Changes Amazon, like many companies interested in drone delivery, faces a complex and daunting regulatory structure managed by the FAA. Legislation recently was introduced to streamline the application process utilizing a “risk-based” assessment using the drone’s weight as the determining factor as to which regulations apply to drone flights. The Increasing Competitiveness for American Drones Act of 2023 is a bipartisan bill with a focus on streamlining the regulatory structure for beyond visual line of sight (BVLOS) operations. Regulations can be as simple as a risk assessment open to audit by the FAA, or a comprehensive type-certification process similar to that currently required for manned aircraft. Proposed Rule Changes Small UAS under 55lbs UAS between 55lbs & 1320lbs UAS over 1320lbs Manufacturers must declare that a risk assessment was conducted and the standard has been met, subject to audit compliance by the FAA. Manufacturers must submit materials to the FAA based on a risk assessment in order to seek a Special Airworthiness Certificate. UAS in this category may be limited to operating no more than 400 feet above ground level. UAS must undergo the full type certification process, which is the standard approval process for crewed aircraft. The Association for Uncrewed Vehicle Systems International advocacy group has publicly stated that it supports the legislation due to their focus on safety relative to the size of operator’s drone. BVLOS regulations present a crucial challenge for UAS operators. With a streamlined approval process, industry advocates hope to encourage further investment in the UAS industry, with a potentially positive impact on the UAS delivery industry.
