Next Up: New framework for cosmetics shipments

The U.S. Food and Drug Administration has not amended its policies regarding the manufacturing, packaging and shipping of cosmetic products since 1938, but this will change come Dec. 29 with the establishment of the Modernization of Cosmetics Regulation Act (MoCRA). DSV recently announced its notice of these changes and says it is working toward compliance with all cosmetic products it processes by the December deadline. “Each product must be registered separately,” DSV said in a release. “Companies with a wide assortment of products will have a larger burden. … DSV will continue to monitor [ Customs and Border Protection ] and FDA communications for additional details as they become available.” Congress appropriated $14.2 million for fiscal 2023, $25.9 million for 2024 and $41.8 million for each year following until 2027 to improve the way cosmetics are manufactured, listed, reported and shipped. Among the changes are safety substantiation, product listing, facility registration and adverse event reporting. Each change comes with its own set of guidelines to determine if the product is safe for shipping, according to a press release by the FDA. “ MoCRA is the most significant expansion of the FDA’s authority to regulate cosmetics since the Federal Food, Drug, and Cosmetic Act was passed in 1938,” the FDA said in the release. “This new law will help ensure the safety of cosmetic products many consumers use daily.”
